Apart from the biometric, there will be also operation “WHO IS YOUR NEIGBOUR” as well as operation “OPERATION WHAT IS YOUR NEIBOUR BIOGRAPHY? ASHAMU FAMILY WRITES LAGOS STATE GOVERNMENT OVER OWNERSHIP OF LAND IN AGIDINGBI, ALAUSA AND MAGODO

 

The family of the late Chief Emmanuel Ashamu has affirmed that the major part of the land in Alausa, Agidingbi and Magodo belong to it, contrary to erroneous impression being created in some quarters.

The family has written to the Lagos State Ministry of Justice, Directorate of Civil Litigation to clarify their claims over the said land. This was in response to the letter written to them by the ministry, trying to affirm the ownership of the land situated at Agidingbi, Alausa, Lagos State.

Mr Victor Omotunde Babatunde Ashamu, the Olori ebi, made this clarification through his counsel that his late father, Chief Ashamu acquired the land from the Ashade family over 57 years ago (as far back as 1963) and that all necessary document such as were acquired to justify the ownership of the land.

A source close to the family, who pleaded for anonymity accused the state government of bias. He said all the documents pertaining to the Agidingbi land are all with them. They are all in the Ministry of Lands and Records. They source, queried the state government’s letter asking the real ownership of the land.

Mr. Ashamu maintained that neither the Akioles nor the Ashamu can make claim to the land. He said that the Akinole’s family judgment and entitlement to the land in Agidingbi was decided as early as 1973 when there was a further dispute between the Ashade family, the original owner of the land that sold to Ashamu and the Akinole family, the late Chief Ashamu persuaded the Ashade family not to go to court but that he would deal with the family on their claim to the Agidingbi land.

“The Akinole family made it clear in the meeting with Chief Ashamu that they were not really in the land but would need money. So an agreement was struck between the parties on the matter and the Akinole family appointed their lawful attorneys under and by virtue of a Power of Attorney dated June 30, 1973 and registered as No. 32 at Page 32 in Volume 1425 of the Land Registry in the office at Lagos. These lawful attorneys, with the knowledge and consent of the whole family, later executed a Deed of Assignment in favour of the late Chief Emmanuel Ashamu, having agreed to a sum of money paid to them on the execution of the document. This Deed of Assignment was dated August 3, 1973 and registered as No. 33 at Page 33 in volume 1432 of the Lands Registry in the office in Lagos”.

According to him, by the above history and the other supporting summary of root of titles, the Akinole family has conveyed all its interest in some of the land at Agidingbi.

Mr. Ashamu maintained that the government cannot pass title for what it does not own. He said he has appointed Mallat and Bowman Limited and Tassan and Bullman Limited to manage his interest in respect of the land. Mallat and Bowman Limited will be the registrar, while Tassan and Bullman Limited is in charge of ‘Operation Show Your Receipt’ and tax clearance.

 

OWNERSHIP/POSSESSION OF LAND IN AGIDINGBI : ASHAMU FAMILY SET THE RECORD STRAIGHT

Sequel to the ongoing tussle over ownership/possession of land in Agidingbi Village, Ikeja, Lagos, the family of late chief Emmanuel Oyedele Ashamu has made further clarification on the matter.

The head of the Ashamu family, Mr Victor Omotunde Babatunde Ashamu, in a release made available to Naija News Direct reiterated that his late father, Chief Ashamu acquired the land from the Ashade family as far back as 1963, and this is supported, among others, by the Deeds of Assignment.

To this end, he maintained that members of the Ashade family or anybody claiming through, or on behalf of them no longer have any interest in the said land. The released statement was also in response to the letter received from Lagos State Ministry of Justice, Directorate of Civil Litigation over the matter.

It’s reliably gathered that the interest of the Ashamus in the land was also confirmed by the Supreme Court in the case of Mogaji v. Cadbury (1985) 2 NWLR (pt.7) 393, where the claim against the party who derived title from Ashamu to a part of the land was dismissed.

Mr Victor Omotunde Babatunde Ashamu, however, maintained that the Lagos State Government cannot pass title for what it does not own. He further revealed that Mallat and Bowman Limited; and Tassan and Bullman Limited have been appointed to manage his interest in respect of the land. Mallat and Bowman Limited will be the registrar, while Tassan and Bullman Limited is in charge of ‘Operation Show Your Receipt’ and tax clearance.

 

RULES AND REGULATION

There are Irrevocable Customary Tenants and Occupiers  Rules and Regulations which it is expected to be followed strictly. They head of family, Victor Omotunde Babatunde Ashami and principal members – Samuel Ishola Ashamu and Oyetayo Ashmau – have appointed Tassan and Bullman Investment Limited, Rhinosour&Camdenlock Real Estate Limited, Ashamu Nigeria Enterprises Limited and other relevant agencies to ensure this rules and regulations are complied with. Among them are: Tenants and occupiers must pay community development charges and local development authority charges, emergency, disaster service charges and first aid disaster and evacuation service charges, research plus development charges inclusive of road development and transport, electricity and security to Rhinosour&Camdenlock Real Estate Limited. They are also to pay Tenants and occupiers must pay job card and security physical planning to Ashamu Nigeria Enterprises Limited. They should be ready to declare their title at any point of request. Environmental sanitation must be obeyed.

In addition, they must be security conscious and report all criminal activities around them. They must notify the landlord of all rent due before the expiring. They must discourage all forms of squatting and encroachment of any self agent against the instruction of the landlord.

It is very paramount for tenant and occupiers to pay all fees such as foundation, decking, roofing, DPT, mortgage consent fee, soil test, accreditation fees ecological and crop fees, data and information technology processing fees to Babatunde Ashamu Investment Limited in order to procure Certificate of Occupancy (C of O), Governor consent e.t.c or face land allocation revocation and must subscribe to Babatunde Ashamu Investment Limited and obey rules, regulation and policies of Babatunde Ashamu Investment Limited. Tenants and occupiers are to show proof of fund and must have a performance bond, registration fees and service charges. Tenants and occupiers must have registration fees and service charges.

 

 

FINALLY: LATE CHIEF E.O. ASHAMU WIN ATUNRASE, MEDINA ESTATES, OTHERS AT APPEAL COURT

The Court of Appeal sitting in Lagos has dismissed an application challenging six respondents’ ownership of land within Atunrase Estate at Gbagada, Lagos State.

A three-man panel of the court unanimously upheld the June 1, 2015 verdict of a Lagos High court which recognised the respondents’ ownership of the land.

The appeal was filed by Mr. Oluhola Atunrase, Mr. Tunji Atunrase, Chief Jimoh Olujinmi Raji, Chief Nze Ezeokoli, Alhaji Tajudeen Mabifa, Dr. Charles Osakwe, Otunba Julius Akinlabi, Alhaji Wasiu Shobowale, Chief Emmanuel Ikenye, Pastor Samuel Adedoye, and Olufemi Apara.

The first to seventh respondents in the suit are Taiwo Seriki Tomori, Harp & Timbrel Limited, Bak Olu Resources Nig. Ltd, Gbolahan Akanbi Timson, Adesesan Dina, Olukoya and Deputy Sheriff High Court of Lagos State.

The appellants had approached the High Court seeking to set aside a consent judgment of October 22, 2008 in suit No. lD/203m/2008 which recognised the respondents as owners of the land.

They claimed that the consent judgment was obtained by fraud and collusion between the parties and therefore null and void.

Aside an order setting aside the execution of the consent judgment, they also sought N25 million damages against the 1st to 6th respondents for illegal execution of the consent judgment.

But the lower court held that their claims were unfounded.

The appellants approached the appellate court in 2018, seeking to upturn the verdict.

But in a December 9, 2020 judgment, Justices Joseph Shagaor Ikyegh, Jamilu Tukur and Ebiowei Tobi threw out the appeal.

Justice Ikyegh, who read the lead judgment, noted that there had been settlement between Chief Atunrase and the respondents in which they (the Atunrases) appeared to concede that a firm, Industrial Chemist, was most probably the owner of land in the area, including at Aturanse Estate.

The late Chief E. O. Ashamu is the owner of Industrial Chemist.

The judge observed that “The respondents contended that the court below was right in holding in its judgment that in the terms of settlement in suit No. ID/371/84 Chief Atunrase and 3 others conceded that Industrial Chemist were the owners of 9 plots of land and paid N90,000 to them from which the court below drew the inference that Industrial Chemist is most probably the owner of surrounding land including Aturanse…”

He also observed that the 1st to 6th respondents proved at the lower court that through their counterclaim “that they have a better title to the land in dispute” than the appellants.

The judge agreed with the lower court that “fraud and collusion which were the double-pronged arsenal deployed by the appellants against the consent judgment were not established.

“In conclusion, I find no merit in the appeal and hereby dismiss it and affirm the judgment of the court below (Taiwo. J.). The appellants shall pay N500,000.00 to the respondents.”
